KDHE Grant 

 The Kansas Department of Health & Environment (KDHE): Kansas Healthy Homes and Lead Hazard Prevention Program (KHHLHPP) is committed to the creation of resources, programs, and policies to prevent childhood lead poisoning and home-based environmental health hazards. For this reason, the Healthy Homes and Lead Hazard Prevention Program applied for a Lead Hazard Control grant through the Department of Housing and Urban Development (HUD) to assist communities with identifying lead hazards in the home.  The Kansas Healthy Homes and Lead Hazard Prevention Program received $3.1 million in Federal Funds to assist in the creation of new resources, programs, and policies to address environmental and lead poisoning hazards in surrounding counties throughout the state of Kansas. EPA's RRP RULE

In an effort to try to address some of the confusion about EPA's Renovation, Repair and Painting (RRP) Rule, we are providing the following. The following information is not being offered as an interpretation of any State or federal regulation, rule, law, and/or statute, but is being provided as an explanation of how we understand the RRP Rule. You must always contact EPA and/or the appropriate State agencies with your questions regarding their interpretation of their own regulations, rules, laws, and/or statutes:

The RRP Rule pertains to all work involving the disturbance of lead-based paint (LBP) that is being provided for Target Housing (basically all pre-1978 residential houses & apartments) and Child-Occupied Facilities (basically all Pre-Schools, Daycares and Kindergartens).

HUD regulations (Lead Safe Housing Rule [LSHR] published on 9/15/99) pertains to all federally owned and federally assisted properties (such as, Section 8, NSP, Weatherization, CDBG, HOME, VA, USDA, etc.).

EPA regulations (Renovation, Repair, and Painting [RRP] Rule published on 4/22/08) pertains to all work in Target Housing and Child-Occupied facilities which are not federally owned or federally assisted.

If someone has received only the HUD Lead-Safe Work Practices (LSWP) training, they must now also receive the RRP Training. If someone received HUD’s LSWP training or EPA’s RRP training (collectively hereafter referred to as LSWP training) from a Company before that Company was accredited by EPA and/or a State to provide the accredited LSWP Training, or, if someone received the LSWP training before EPA's new RRP training curriculum came out in February of 2009, then the LSWP training they received is no longer valid and they are now required to take the full 8-hour LSWP class using the new EPA training curriculum. If they took the full 8-hour HUD LSWP class before a Company was EPA/State accredited or before the new EPA curriculum came out and they received that training from a firm like Baker Environmental Consulting, Inc. (BEC, a firm recognized by EPA), then those people are now required to only have to take a 4-hour LSWP refresher class from an accredited training provider (such as from BEC). Renovation projects also require the renovation firm to be EPA and/or State licensed as a Renovation Firm. Renovation firms and individual Certified Renovators must renew the Licenses and Certifications at least every 5 years under the EPA's RRP Rule. Before a Certified Renovator can renew their individual certification, they must take at least a 4-hour LSWP Refresher training course from an accredited training provider (such as from BEC).

On HUD projects, if it is NOT an abatement project (if it is a renovation, rehab, repair, maintenance, painting, or paint stabilization type project), HUD requires everyone to receive LSWP training from an EPA and/or State accredited training provider (such as from BEC) and to be certified by EPA/State (KS has their own certification/licensing requirement, which is separate and aside from EPA). These people can be certified by the State as an Abatement Worker or Abatement Supervisor, but they must have the LSWP certification as well. 

On HUD Projects, if it IS an abatement project, then everyone must be certified by the EPA/State as an Abatement Worker or Abatement Supervisor (at least one abatement Supervisor on every job), plus, they must be EPA/State certified as a Renovator by taking the LSWP class from an accredited training provider (such as from BEC). Abatement projects also require the firms to be licensed as a Lead Activity/Lead Abatement Firm.

Descriptions of Courses Offered by Baker Environmental Consulting, Inc.

 

Lead Hazard Awareness

Any employee that works on any construction related project that may involve exposure to any type or form of a lead containing material, such as lead-based paint, MUST be given Lead Hazard Awareness training. Under the OSHA regulations governing Hazard Communication and Lead Exposure in the Workplace, employees must be given education/training about their exposures. This specialized training course allows employers to comply with the OSHA regulatory requirements, while it assists employees by informing them how to help protect themselves and their families from the hazards of lead. A few of the topics of discussion include; What are the hazards of lead exposure, What are the effects of lead exposure, How an employee can be exposed to lead while doing their job, and How an employee can prevent exposure to lead when doing their job.

RRP Lead-Safe Work Practices *

All persons who provide any construction trade services (e.g., Carpenters, Painters, Renovators, Remodelers, HVAC Persons, Plumbers, Electricians, Sheetrockers, Repair Persons, Maintenance Persons, Roofers, Flooring/Carpet Installers, Landlords, etc.) in houses built before 1978 are required to attend this 1-day professional training course. Under the Lead-Safe Housing Rule of September 15, 1999, this course is mandated for any and all persons and firms that work on federally owned or federally assisted/funded residential dwelling units that were built before 1978, when any work in that structure will impact at least 2 square feet of a surface area.  Under the RRP Rule of April 22, 2010 (be advised that some states put regulations into effect earlier), any and all persons working on any pre-1978 residential property, Pre-School Facilities, Daycare Facilities or Kindergartens, where they will impact equal to or greater than 6 square feet of any surface coating, are mandated to have successfully completed this professional 1-day training course. Additionally, all persons will be required to be licensed/certified by the appropriate State agency where the work is occurring or by EPA. There is also be a requirement for refresher training for any person who becomes licensed/certified. The reason for the mandate to complete the training is due to the fact that persons in construction related trades have a much higher incidence of causing lead poisoning, including the poisoning of their own families, than most all other trades combined. It is also known that the typical way that construction work has been done/is still being done often ends up causing lead poisoning of the people who currently live in (or will live in) the structures being worked on.The objective of the course is to assist people in the construction trades to do their jobs in a manner that will greatly reduce the likelihood of exposure to the hazards of lead, for themselves, their families, their co-workers, and for the people whose homes are being worked on.

Lead Abatement/Hazard Control Worker *

Any and all employees who perform activities that have the potential to disturb lead containing materials (LCM), such as lead-based paint (LBP), must receive KDHE or DHSS accredited 24 hours of training prior to engaging in these activities. Attendees will learn about the historical uses of lead, the health effects of lead exposure, the OSHA Lead Standard, EPA and HUD Regulations regarding lead, personal protection equipment, and proper safety procedures for removing lead-based paint and handling materials containing lead.

Lead Abatement/Hazard Control Supervisor *

This 40 hour course meets the KDHE & DHSS training requirements for individuals supervising or overseeing projects involving the disturbance of lead-based paint. Topics covered include: where lead is found today, historical and current uses of lead, health effects, medical monitoring, personal protective equipment, testing for lead, hazard control activities, engineering controls, legal liability, insurance considerations, community relations, supervisory skills and practices, and waste disposal.

Lead-Based Paint Inspector *

This 24 hour professional course is for persons who want to determine the presence of lead-based paint (LBP) in target housing, child-occupied facilities, commercial & public buildings, and industrial structures/facilities. Participants are given information about where to find lead in most structures, why lead has been used,  "state of the art" sample collection, and reporting requirements. This course also includes discussions on radiation safety for x-ray fluorescence (XRF) analyzers, theory and uses of XRF devices and the extreme importance of conducting a thorough LBP Inspection.

Lead Hazard Risk Assessor *

To take this 16 hour course, persons must first successfully complete the 24 hour LBP Inspector course. This course is designed to "build upon" the LBP Inspector course and provide course attendees with information about identification of lead hazards, so as to assist in the prevention of lead poisoning. Other topics of discussion include; liability considerations, the several different types of Risk Assessments (RA), procedures for accomplishing the various types of RA, the importance of visual examinations and what to look for, various causes of exposure to lead hazards due to paint and/or structural integrity failure, investigations of sources of exposure when a child has been lead poisoned, and how to figure pricing for the conduct of a RA. Many hands-on group exercises are used to assist in understanding the concepts.

Lead Project Designer *

Persons taking this eight (8) hour professional training course must have first successfully completed the 40 hour Lead Hazard Control Supervisor Course. A Project Designer (PD) has the important purpose of reviewing and interpreting LBP Inspection and Risk Assessment reports, determining the existence of problem areas, considering the efficacy of various strategies of lead hazard control, and providing applicable and appropriate methods of control. The course discusses how the PD has the responsibility to develop effective lead hazard control specifications, to design a lead hazard control project from start to finish and to provide cost effective and approved plans to properly address lead-based paint hazards.

* Refresher classes for the above certification/licensure courses are also available (required by EPA, KDHE and/or DHSS)

Once we receive this information from you, a Training Agreement will be mailed, emailed, and/or sent by fax. 

Please register early, since we need a certain number of attendees in order to be able to put a class on. A filled out, signed and returned Training Agreement is what we use to confirm a reservation in a particular course. Additionally, we need the filled out and signed Training Agreement so that we will know the exact number of manuals to have available and how large of a classroom to setup.

SPECIAL NOTE:

Baker Environmental Consulting, Inc. is pleased to announce that we have been awarded a 3 year training contract with the Kansas Department of Health and Environment (KDHE) to provide professional abatement training. Under this contract with KDHE, Baker Environmental Consulting, Inc. will be giving persons the benefit of our years of hands-on experience and technical expertise in lead abatement, which has been developed as a result of starting to provide lead abatement activities in March of 1976. We are also very proud to annouce that effective December 22, 2009, BEC has received full and formal Nationwide accreditation from EPA to provide training for "Lead Safety During Renovation, Repair and Painting", also often known as Lead-Safe Work Practices (LSWP) Training. This is the EPA mandated training, as required under the new EPA Rule referred to as the "RRP Rule" (Renovation, Remodeling and Painting Rule). Effective April 22, 2010, on a Nationwide basis (be advised that some states may put regulations into effect earlier), all persons who provide construction trade services (e.g., Carpentry, Painting, Renovation, Remodeling, HVAC, Plumbing, Electrical, Modernization, Roofing, Carpet Installation, Repair, Maintenance, etc.), where they will impact equal to or greater than 6 square feet interior, or equal to or greater than 20 squre feet exterior, of any lead-containing material/paint/surface coating will be mandated to have successfully completed this professional 1-day training course. All persons will also be required to be licensed/certified by the appropriate State agency where the work is occurring or by EPA. Lead Safety Training, as well as the documented and proper use of lead-safe work practices will be required for all persons nationwide.
